Permanent incapacity and continued employment in Spain

Permanent incapacity is a social security protection status linked to functional impairments affecting working capacity under the conditions established by law. It is classified into degrees and is not equivalent to a preventive fitness-for-work assessment. Recognition requires a decision by the competent authority.

In brief

Permanent incapacity is a status recognised by Social Security, distinct from fitness for work and disability. The 2025 reform removes automatic termination for certain degrees and requires consideration of adjustments or compatible positions under the prescribed procedure and circumstances.

Degrees and concepts to keep separate

Spanish Social Security distinguishes partial, total and absolute permanent incapacity, and severe incapacity (gran incapacidad). Each degree has specific requirements and effects. The term gran incapacidad replaced gran invalidez following the 2025 reform.

Do not infer a degree solely from a diagnosis. Nor should a finding of unfitness for a role be treated as recognition of entitlement to a benefit. Preventive fitness assessments, incapacity and administrative recognition of disability answer different questions and follow different procedures, although they may be related.

The role of the cause of harm

Whether the cause is occupational or non-occupational can affect protection requirements and consequences. The contingency is determined through the competent mechanisms; the employer cannot decide it on the basis of suspicion.

From a preventive perspective, objective information on tasks, exposures and measures should be retained where necessary. Preventive investigation and protection of other exposed people should not wait for a benefits dispute to conclude. Avoid sharing clinical data with managers who need only know functional limitations or protective measures.

What changed in the employment relationship

Law 2/2025 removed automatic contract termination following a declaration of total or absolute permanent incapacity or severe incapacity. The current regime provides for reasonable adjustments and possible compatible vacancies under the conditions of Article 49.1.n of the Workers’ Statute.

This means neither unconditional continued employment nor unrestricted termination. Circumstances must be analysed and decisions justified. Pre-reform explanations presenting recognition as automatic termination of the contract can lead to significant errors.

Deadlines and preventive involvement

The reform gives the person ten calendar days from notification to state in writing their wish to retain the employment relationship. The employer has a maximum of three months from its notification to make adjustments or change the role and, in the prescribed circumstances, issue the corresponding reasoned decision.

Prevention services determine the characteristics of adjustments and identify compatible positions, with the prescribed consultation of preventive representatives. Specific application requires attention to dates, the decision and the contractual situation, rather than transferring a generic timetable to every case.

Coordinating adjustment and social protection

Adjustment requires analysing actual tasks, functional capabilities, training and safety conditions. The compatibility of employment and benefits depends on the applicable regime, degree and activity; retaining employment does not justify assuming that any pension can be received simultaneously without changes.

Separate medical, preventive, employment and social security decisions while coordinating those responsible. Record alternatives examined and reasons. The person should be able to understand the process without disclosing their entire medical history to every participant.

Hypothetical example: examining an alternative

A person communicates a decision and expresses a wish to continue working. The employer initiates a review under the applicable framework. Prevention professionals analyse duties, adjustments and possible compatible positions, incorporating the necessary functional information.

Before deciding, feasibility, training and the relevant Social Security consequences are checked. The example does not predict an outcome or benefit: it shows why a decision must not automatically become termination of employment without examining current duties.
